Question: Can employees from the new EU countries (Estonia, Latvia, Lithuania, Poland, Slovakia, Slovenia, Hungary, and the Czech Republic) work in Denmark without a residence and work permit?
Answer:
Yes, in some instances. Denmark has imposed temporary transitional rules, which require wage earners from Estonia, Latvia, Lithuania, Poland, Slovakia, Slovenia, Hungary, and the Czech Republic to hold work and residence permits to legally accept paid work in Denmark. Wage Earners stationed in Denmark by a company based in another EU/EEC country are not required to hold work and residence permits if the following conditions are met:
* The worker must be a permanent employee of a company based in another EU/EEC country, providing services in Denmark.
* The worker must, prior to his or her departure, be a legal resident of the corporate home country, with a right to seek work in that country.
* The worker must be in compliance with the Danish Immigration Law\'s statues on entry and residence: ie., the individual must either be visa-free, or hold a valid visa or residence permit.
* The worker must have the opportunity and express intention of returning to his or her home or work country after the completion of duties in Denmark.
* The worker may be a citizen of one of the aforementioned countries, or a citizen of a third country, i.e. a country outside the EU/EEC.
There will be no exemption for work and residence permits in the following cases:
* If the worker is solely employed as a seasonal worker, day labourer, temporary work, or otherwise loosely associated with the stationed company.
* If the worker is employed in a firm established in order to avoid the regulations stated in Denmark\'s transitional rules.
If the work assignment exceeds the period of time in which the worker can reside in Denmark either with a visa or as a visa-free resident (3 months), he or she must apply for a residence permit with the Danish Immigration Service.

Teoretycznie, jesli zamierzasz pozostac w Danii dluzej niz 3 miesiace, musisz miec pozwolenie. Przykladem sytuacji gdzie nie jest to wymagane, moze byc firma budowlana, zarejestrowana w PL ktora swiadczy uslugi w Danii (remont domu) i bedzie to trwalo 4 tyg.
Pozdrawiam.
